Terms of Service

Last updated: 28 September 2026

These Terms of Service ("Terms") govern your use of Orchard, a service operated by Ross Hidge, a sole trader based in the United Kingdom ("we", "us", "our"), accessible at orchapp.dev and through any related mobile or desktop applications (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. What Orchard does

Orchard is a tool that lets you describe an iOS app in natural language, generates the underlying code using AI models, and builds and deploys the resulting app to Apple's TestFlight and App Store on your behalf. The Service includes:

We may change, suspend, or discontinue any part of the Service at any time, with reasonable notice where practical.

2. Your account

You must be at least 18 years old to create an account. You are responsible for keeping your account credentials secure and for all activity that happens under your account. You must notify us at support@orchapp.dev if you suspect unauthorised access.

You agree to provide accurate information when registering and to keep that information up to date. We may suspend or terminate accounts that contain false information, that are used to violate these Terms, or that we reasonably believe pose a risk to the Service or other users.

3. Plans and pricing

Orchard is offered on a tiered basis (currently Free, Pro, and ProMax). Current pricing, included usage, and feature differences are published on our pricing page, which forms part of these Terms.

Paid subscriptions are billed in advance, on a recurring basis, through our payment processor Stripe. You can cancel a paid subscription at any time from your account settings; cancellation takes effect at the end of the current billing period, and we do not provide refunds for partial periods except where required by law.

We may change pricing with at least 14 days' notice before the change applies to your account. If you do not accept a price change, you can cancel before it takes effect.

If your usage materially exceeds the limits of your plan (for example, by generating an unusually high volume of apps), we may contact you to discuss a more suitable plan or apply reasonable limits.

4. Your content and your apps

Your prompts and your apps belong to you. You retain all ownership rights in:

We claim no ownership over Your Apps. You are free to download, modify, distribute, or relicense them.

You grant us a limited, non-exclusive licence to host, process, transmit, build, and deploy your content and Your Apps solely for the purpose of providing the Service to you. This licence ends when you delete your content or close your account, except to the extent we are required to retain it for legal, security, or backup purposes.

5. Your responsibilities for Your Apps

When you use Orchard to build and ship an iOS application, you are the developer of that application in the eyes of Apple, your users, and the law. This means:

Orchard provides infrastructure and code generation; it does not provide legal, tax, or regulatory advice about Your Apps.

6. Acceptable use

You agree not to use the Service to:

We may suspend or terminate accounts that violate this section, and where required by law we may report serious violations to relevant authorities.

7. AI-generated content disclaimer

Orchard uses AI models to generate code and other content on your behalf. AI-generated output can contain mistakes, bugs, security vulnerabilities, inaccurate text, or content that resembles existing works. You are responsible for reviewing, testing, and validating Your Apps before publishing them.

We do not guarantee that AI-generated output is bug-free, secure, compliant with any specific law, fit for any particular purpose, or non-infringing. You should treat all AI-generated output as a starting point that requires your own review and testing.

Orchard is designed to guide AI models toward complete, working apps: we shape the instructions each model receives, check what it returns, and compile and verify changes before they reach you, and we keep improving that process. However, the code and content themselves are produced by third-party AI models whose capabilities, behaviour and availability are outside our control. AI models can misunderstand a request, leave a feature incomplete, introduce a problem while fixing another, or describe work as finished when it does not fully behave as described. Some features, such as those relying on device hardware (for example Apple Pencil, cameras, sensors or background audio), can only be confirmed on a real device and may not be fully testable in the in-browser preview. More complex apps may need several rounds of changes and testing to reach the result you want.

Generating and changing apps uses your plan's allowance whether or not a particular result meets your expectations, except where we state otherwise (for example, where a failure is caused by our own systems).

8. Service availability

We aim to keep the Service available and performant, but we do not guarantee uninterrupted availability. The Service depends on third-party infrastructure (including Apple, Anthropic, Supabase, Stripe, Render, Scaleway, Fly.io, Appetize.io, and Sentry), and outages or changes in those services may affect Orchard.

We may carry out planned maintenance or release updates that temporarily affect the Service. Where practical, we will give advance notice for significant scheduled downtime.

9. Third-party services

Using Orchard requires you to connect to or rely on several third-party services, including Apple's Developer Programme and App Store Connect. Your use of those services is governed by their own terms, not by these Terms, and we are not responsible for their actions, decisions, or policies (for example, an Apple App Store review rejection or account suspension).

10. Intellectual property in the Service

The Service itself, including the orchapp.dev website, the user interface, the underlying generation pipeline, our brand assets, and any documentation, is owned by us or our licensors and is protected by intellectual property laws. These Terms grant you no rights in the Service itself beyond the right to use it as permitted.

11. Termination

You may close your account at any time from your account settings or by emailing support@orchapp.dev.

We may suspend or terminate your account if you breach these Terms, if your continued use poses a risk to the Service or to others, if we are required to do so by law, or if we discontinue the Service.

On termination, your right to use the Service ends. We will retain or delete your content in line with our Privacy Policy. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, liability limits, and governing law) will continue to apply.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.

We do not warrant that:

Nothing in this section limits any rights you have as a consumer that cannot be excluded under applicable law (including under the UK Consumer Rights Act 2015).

13. Limitation of liability

To the maximum extent permitted by law:

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

14. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before they take effect. Continued use of the Service after the changes take effect means you accept the updated Terms. If you do not accept them, you must stop using the Service before the change date.

16. Governing law and disputes

These Terms are governed by the laws of England and Wales. You and we agree that the courts of England and Wales have exclusive jurisdiction to resolve any disputes arising out of or in connection with these Terms or the Service, except that consumers may also bring proceedings in the courts of their country of residence where required by law.
